Work Place Mediation

Workplace Mediation is becoming an important tool for employers to access. Mediation is cost effective to everyone involved and offers an impartial, independent mediator who works to get a positive outcome for both employer and employee.

Below are two recent cases Bliss has helped to mediate, avoiding loss of employment and employment tribunal.

Bliss was involved in a disciplinary hearing for a staff member at Arco.

A mediator supported the worker and the company throughout the disciplinary meeting process and at the appeal hearing.

The outcome was favourable to both the worker and the company; allowing the company and the worker to improve communication within the organisation to avoid further issues in the future.

Bliss supported a teacher at her two sickness hearings.  Bliss highlighted the best practice and health and safety requirements for a pregnant woman.  The meeting ended on a positive note and both parties could move on.

Mediation can be brought into a process at any stage, and is a quick and cost effective method of resolving disputes between employer and employee, thus avoiding costly employment tribunal cases, also retaining valued employees; Highlighting areas in the process that could be improved or cost the company dearly at tribunal.

3/5 of organisations surveyed by CIPD have never used mediation as a technique to help manage conflict.

However of the firms that do utilise the skills of mediation over 80% reported that it helped to improve relationships between staff. 71% claimed it reduced stress involved with the use of formal disciplining or grievance procedures.

All employers should consider using mediation as a flexible alternative to disiplinary procedures.

More organisations should invest in training line managers in conflict management and informal mediation skills.
